BETWEEN: Crew Energy Inc. (APPLICANT) AND:

Ardills Ranch Ltd. (RESPONDENT) ____________________________________ BOARD ORDER _____________________________________

CREW ENERGY INC. v. ARDILLS RANCH LTD. ORDER 2173-1 Page 2

Crew Energy Inc. (“Crew”) seeks a right of entry order to access certain lands to carry out an oil and gas activity, namely to construct, drill and operate a single petroleum and natural gas well with associated infrastructure on one wellsite.

Crew applied to the Board, asking the Board to issue a right of entry order for this project. The Applicant and the Respondent have reached an agreement with respect to the amounts of initial and annual compensation and proposed terms of a right of entry order, which is found in the consent order below.

This well is supported by the BC Oil and Gas Commission’s Permit (Application Determination Number 100110475; Well Authorization No.:40310), I find it is an approved oil and gas activity.

The Surface Rights Board Orders by consent: 1. Upon payment of the amount set out in paragraph 2, Crew shall have the right of entry to and access the portions of the Lands shown outlined in red on the Individual Ownership Plan attached as Appendix “A” to construct, drill and operate a single petroleum and natural gas well with associated infrastructure.

2. Crew shall make a onetime payment to the landowner of $2,000.00 in consideration of the landowner’s expeditious consent granted above, and the avoidance of any further Board process.

3. Crew shall deliver to the landowner annual compensation of $1,500.00 per year until a Certificate of Restoration has been obtained for the wellsite. This amount is in consideration of the expeditious granting of consent and the avoidance of any further Board process.

4. Crew shall construct the wellsite and fence the wellsite prior to May 15, 2021.

5. Crew will adhere to the posted speed limits and reduce speed to no more than 50 km/hr within 500 metres of the wellsite.

6. Nothing in this order operates as a consent, permission, approval, or authorization of matters within the jurisdiction of the Oil and Gas Commission.
