1058300 BC LTD. v. TALLAHASSEE EXPLORATION INC. ORDER 2177-1 Page 2 This is an application brought under sections 164 and 176 of the Petroleum and Natural Gas Act. The Applicant, 1058300 BC Ltd., is the owner of the Lands described as: PARCEL A (N11404) OF THE SOUTH WEST ¼ SECTION 16 TOWNSHIP 85 RANGE 17 WEST OF THE 6 TH MERIDIAN PEACE RIVER DISTRICT. The Respondent, Tallahassee Exploration Inc., is the operator of a well site on the Lands. The Respondent’s right of entry to the Lands for the purpose of operating the well is pursuant to a surface lease dated June 7, 1994 (the Surface Lease). 1058300 BC Ltd. purchased the Lands November 19, 2019. Pursuant to the Surface Lease, Tallahassee Exploration Inc., is required to make annual payments of $1,950.00 to 1058300 BC Ltd as owner of the Lands. Tallahassee Exploration Inc. failed to make the annual payments required by June 7, 2020 and June 7, 2021. The Board finds that Tallahassee Exploration Inc. has failed to pay rent owing under a surface lease. Pursuant to section 176 of the Petroleum and Natural Gas Act, the Board determines that Tallahassee Exploration Inc. owes 1058300 BC Ltd. $1,950.00 in unpaid rent plus interest from June 7, 2020 and $1,950.00 in unpaid rent plus interest from June 7, 2021. The Applicant is entitled to costs of this application. The Board orders as follows: 1. Tallahassee Exploration Inc. shall forthwith pay to 1058300 BC Ltd. the sum of $1,950.00 plus interest calculated in accordance with the Court Order Interest Act from June 7, 2020; and 2. Tallahassee Exploration Inc. shall forthwith pay to 1058300 BC Ltd. the sum of $1,950.00 plus interest calculated in accordance with the Court Order Interest Act from June 7, 2021.
